Terms of Service

1. Acceptance of Terms

By accessing or using Fore (the "Service"), including by creating an account, using the mobile application, or sending or receiving SMS messages, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Fore is operated by Thomas Xu, a sole proprietor based in Washington State, United States ("we", "us", "our").

2. Description of Service

Fore is a golf round coordination platform that helps golfers organize rounds, invite friends, and manage tee times. The Service includes a mobile application and SMS-based messaging features.

3. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. We do not knowingly permit anyone under 18 to use the Service; if we learn that an account belongs to a user under 18, we may suspend or delete that account.

4. Accounts

To use most features, you must create an account with a valid phone number. You are responsible for (a) keeping your account credentials and device secure, (b) all activity that occurs under your account, and (c) the accuracy of the information you provide. You agree to notify us promptly at support@gofore.app if you suspect unauthorized access to your account or if your phone number changes.

5. SMS Messaging Program

When you create an account or use Fore's round-coordination features, you may send or receive the following types of text messages:

• Account verification codes;
• Round invitations from other Fore users;
• RSVP confirmations and updates;
• Tee-time reminders.

Message frequency: Frequency varies with your activity and the activity of your friends. A typical active user receives approximately 1–10 messages per month.

Message and data rates may apply. You are responsible for any messaging or data charges from your mobile carrier.

By providing your phone number and using the Service, you consent to receive recurring automated text messages from Fore for the purposes listed above. Consent to receive SMS is not a condition of any purchase of any goods or services.

Opting out: You may opt out of SMS at any time by replying STOP to any message you receive from us. You will receive a one-time confirmation message; you will not receive further messages unless you re-subscribe.

Carrier support: The SMS program is available to users with a mobile phone capable of receiving text messages on supported U.S. carriers, including T-Mobile, AT&T, Verizon, and other major carriers. Wireless carriers are not liable for delayed or undelivered messages.

6. Inviting Others — Your Responsibility

Fore allows you to invite people to rounds by phone number. When you do so, our system sends an SMS on your behalf identifying you as the inviter. By using the invite feature, you represent and warrant that:

• You have an existing personal relationship with each person you invite;
• Each invited person would reasonably expect to be contacted by you about a golf round;
• You will not use the invite feature for marketing, promotional, or commercial purposes;
• You will not invite anyone who has previously asked you to stop contacting them.

You agree to defend, indemnify, and hold us harmless from any claims arising from invitations you initiate, including claims under the Telephone Consumer Protection Act ("TCPA") or analogous state laws.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Impersonate any person or entity, or misrepresent your affiliation;
• Harvest, scrape, or collect data from the Service without our express permission;
• Use the Service to send spam, marketing solicitations, or unsolicited contact;
• Reverse engineer, decompile, or attempt to derive source code from the application;
• Probe, attack, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
• Upload or transmit content that is harassing, threatening, obscene, hateful, infringing, or otherwise objectionable;
• Violate the rights (including intellectual property and privacy rights) of others.

8. User Content

You retain ownership of any content you submit to the Service, including your profile photo and any text you provide ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your User Content solely for the purpose of operating and providing the Service to you and the people you invite or befriend. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.

9. Termination

You may stop using the Service or request account deletion at any time by contacting support@gofore.app. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe in good faith that you have violated these Terms, that your use creates risk or legal exposure for us or others, or that we are required to do so by law. Sections that by their nature should survive termination will survive (including ownership, indemnification, disclaimers, limitation of liability, and dispute resolution).

10. Third-Party Services and Content

The Service displays information from third-party sources (e.g., golf course details from GolfCourseAPI.com, course imagery from Google Places, weather from Open-Meteo) and relies on third-party platforms (e.g., Apple, Google, Twilio, Cloudflare) to operate. We do not control and are not responsible for third-party content, services, or platforms, and your use of them is subject to their terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT SMS MESSAGES WILL BE DELIVERED OR DELIVERED ON TIME, THAT COURSE OR WEATHER INFORMATION WILL BE ACCURATE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) ONE HUNDRED U.S. DOLLARS (US$100) OR (b) THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the greatest extent permitted by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Thomas Xu and his affiliates, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your User Content; (d) invitations you initiate via the Service; or (e) your violation of any law or third-party right.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Subject to Section 15 (Arbitration), the exclusive venue for any judicial proceeding shall be the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.

15. Mandatory Arbitration and Class Action Waiver

Read this section carefully — it affects your legal rights.

Arbitration agreement: Except as provided below, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules & Procedures, rather than in court. The arbitration will take place in King County, Washington, unless we agree otherwise in writing, or, at your request, via video or telephone hearing. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class action waiver: You and we agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Notwithstanding any other provision of these Terms, the arbitrator may not consolidate claims of multiple persons and may not preside over any form of representative or class proceeding.

Exceptions: Either party may bring an individual action in small-claims court for disputes that qualify, and either party may seek injunctive or equitable relief in court to protect intellectual property rights.

30-day opt-out: You may opt out of the arbitration agreement and class action waiver by emailing support@gofore.app within 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your full name and the phone number associated with your Fore account. If you opt out, the rest of these Terms still apply.

If any portion of this Section 15 is found unenforceable, that portion will be severed and the remainder of Section 15 will continue to apply.

16. Apple-Specific Terms

If you obtain the Fore mobile application from the Apple App Store, you acknowledge that: (a) these Terms are between you and us only, not with Apple, and Apple is not responsible for the Service or its content; (b) Apple has no obligation to provide maintenance or support; (c) in the event of any failure of the app to conform to any applicable warranty, Apple may refund the purchase price (if any), and to the maximum extent permitted by law, Apple has no other warranty obligation; (d) Apple is not responsible for addressing claims relating to the app or your possession or use of it, including product liability claims; (e) Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

17. Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with a revised effective date and, where reasonably possible, communicated through the app or by email. Your continued use of the Service after the effective date of the changes constitutes acceptance of the updated Terms.

18. Miscellaneous

These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be a waiver of that right. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, or by operation of law.
